Ukrainian trade standards

Many foreign companies view the Ukrainian standards and its technical regulation system as a significant obstacle to investment and trade.

Over the past few years, Ukraine has largely reformed its technical regulation system to bring it in line with WTO requirements.

In addition, Ukrainian standards are actively unifying for EU requirements within the framework of the free trade agreement between Ukraine and the European Union. In 2016, Ukraine introduced several significant legislative amendments:

  • June 5, 2014 Law of Ukraine No. 1315-VII “On standardization”.
  • February 10, 2014. Law of Ukraine No. 1314-VII “On Metrology and Metrological Activity”.
  • December 8, 2015. Law of Ukraine No. 867-VIII “On Amendments to Certain Legislative Acts of Ukraine Concerning Regulation in Agriculture”.

General information about trade standards in Ukraine.

Ukrainian standards are developed by the State Enterprise “Ukrainian Research and Training Center for Certification, Standards and Quality”.

Technical standards are coordinated by the Department of Technical Regulation of the Ministry of Economic Development and Trade of Ukraine.

Compliance with Ukrainian standards and food quality control is carried out by the State Inspectorate for Consumer Protection and Food Safety.

Certification in Ukraine is a paid service provided by about 100 accredited agencies. A list of Certification Agencies is listed in the National Accreditation Agency.

The certification process depends on the type of testing, product type and certification scheme and can take up to 30 days.

Conformity assessment in Ukraine.

In September 2017, the Cabinet of Ministers of Ukraine canceled the mandatory application of national standards by approving amendments to the Law of Ukraine “On Standardization”.

The application of national standards and the corresponding certification since 2017 are voluntary, but not mandatory within the framework of the requirements of the Agreement on Technical Barriers to Trade of the World Trade Organization.

Situations in which standardization is necessary for the development, production and supply of goods are described in the Commercial Code of Ukraine, article 15:

1. A supplier or manufacturer of goods has added a declaration of conformity to the list of requirements for certain standards.

2. The supplier or manufacturer has indicated the standard on their label.

3. When the application of codes and standards of established practice is regulated by law.

Companies that import products from Ukraine can order certification of an object abroad in accordance with the technical regulations of Ukraine.

This certification process includes a visit by a representative of the Ukrainian government to a foreign site. The customer pays the cost of transport.

In case of obtaining a certificate, the supplier gets rid of the need for certification and laboratory testing of goods in each separate batch for a period of 2 to 5 years

According to the Resolution of the Cabinet of Ministers No. 139 “On Approval of the Technical Regulations for Restricting the Use of Certain Hazardous Substances in Electrical and Electronic Equipment” and No. 1067 “Technical Regulations for Low-Voltage Electrical Equipment”, the Declaration of Conformity is required for certain products for release on the Ukrainian market. This declaration can be issued by the Official Ukrainian Certification Center. Inspection, testing and certification in Ukraine.

Importers of Ukrainian products have the right to choose what type of technical standards certificates to receive:

  1. Certificate of technical standards for up to 2 years. For this, it is necessary to check the production capacity.
  2. Certificate of technical standards for a period of 1 year. One or two random tests must be performed to validate this certification.
  3. Certificate for one batch of goods.

To obtain Ukrainian certificates, you must prepare the entire package of documents in Ukrainian. Basic list of documents:

  • Declaration of intent to obtain a certificate of technical standards for imported products;
  • Certificate of origin.
  • Certificate of conformity;
  • Use guides, if any;
  • Testing laboratory accreditation certificate;
  • Technical standards for products and certification procedure;
  • Quality control certificate;
  • Test results report.

The list of necessary documents for obtaining a certificate of technical standards is regularly updated and supplemented. For this reason, we recommend that you update the list with an accredited certification body. We also recommend you to apply for the certificates with the Ukrainian lawyer or together with your distributor in Ukraine.
